It stated that demolitions should not proceed without lawful notice and emphasized that all states are required to comply with this mandate.
The court underscored that suspects should not be deemed guilty until proven, and no presumption of guilt can be made before the conclusion of an investigation. Punitive actions, it asserted, should be strictly based on a lawful conviction. The court also declared that demolishing an accused person’s residence is illegal, as it infringes on their fundamental right to housing.
