West Bengal Chief Minister Mamata Banerjee has refused to accept the election verdict and stated that she will not resign from her post, even after the Trinamool Congress (TMC) suffered defeat in the assembly elections. Her remarks have triggered a political controversy, with Mamata alleging that the Election Commission, in collusion with the BJP, influenced the electoral process. She maintained that her party was not defeated fairly, further intensifying post-poll tensions in the state.

The BJP, which secured a decisive mandate, is proceeding with plans to form the new government on May 9. Despite the incumbent Chief Minister’s refusal to step down, preparations for the swearing-in ceremony are underway. The development has added an unusual dimension to the transition of power, drawing national attention to West Bengal’s political situation.

Constitutional experts and senior legal authorities have clarified that Mamata Banerjee’s refusal to resign will not affect the formation of a new government. They noted that the current West Bengal Legislative Assembly’s term is set to expire on May 7, 2026, after which the Governor holds the authority to dissolve the Assembly and the existing government structure.

Under Article 164 of the Constitution, a Chief Minister can remain in office only with legislative legitimacy and the support of a functioning assembly. Once the term ends or a new majority is established, the Governor is empowered to appoint a new Chief Minister and facilitate the formation of a new government, irrespective of resignation by the outgoing leader.

Former Lok Sabha Secretary General P.D.T. Achary stated that if Mamata Banerjee wishes to challenge the election results, she can do so only through an election petition in the appropriate legal forum. Until such proceedings are adjudicated, she cannot continue in office against constitutional provisions. Political analysts further noted that the new government formation and swearing-in process is expected to proceed as scheduled, ensuring a constitutional transfer of power in West Bengal.
