Kavitha, who is out on bail and has surrendered her passport, requires court approval for foreign travel. In its order, Judge D. Vinay Singh noted that the right to travel abroad forms part of the right to life and personal liberty under Article 21 of the Constitution, adding that she poses no flight risk given her strong social ties. The court recalled her previous U.S. trip in May for her elder son’s graduation, during which she adhered to all conditions.
The CBI and Enforcement Directorate opposed the petition, expressing concerns about potential evidence tampering and delays in the probe. However, the court dismissed these objections, expressing confidence she would return as scheduled and cooperate with the investigation.
