The United States government has provided significant relief to foreign nationals seeking Green Cards by softening its stance on a controversial directive issued last week. The Department of Homeland Security (DHS) has clarified that not all Green Card applicants will be required to return to their home countries while their applications are being processed. Instead, only certain applicants may be asked to do so, depending on their individual circumstances. DHS emphasized that the updated guidance does not represent a major departure from existing immigration regulations.

As part of President Donald Trump’s immigration control policies, U.S. Citizenship and Immigration Services (USCIS) spokesperson Jack Kahler had announced last week that individuals residing in the U.S. on temporary visas and applying for permanent residency would be required to return to their home countries until the Green Card process was completed. He had stated that, except under extraordinary circumstances, the rule would apply broadly, triggering widespread concern among immigrant communities across the country.

Existing Adjustment of Status Process Remains
Under current immigration rules, eligible foreign nationals can remain in the United States while waiting for approval of their Green Card applications through a process known as “Adjustment of Status.” This mechanism allows immigrants sponsored by employers or close family members to apply for permanent residency without leaving the country.

In 2024 alone, approximately 1.4 million Green Cards were issued through this pathway. However, a memorandum released on May 21 proposed stricter measures aimed at closing perceived loopholes and preventing applicants whose Green Card petitions are denied from remaining in the country unlawfully. The memo suggested requiring applicants to return to their home countries while awaiting decisions.

DHS Clarifies Discretionary Nature of Policy
Following strong criticism of the proposal, a DHS spokesperson clarified that the requirement is not a blanket rule. Whether an applicant must return to their home country will depend on the discretion of immigration officials handling the case. Authorities will make decisions based on the specifics and seriousness of individual cases, a power they have long possessed under existing regulations.

Officials also noted that individuals whose presence benefits the U.S. economy or serves national interests may qualify for exemptions from the requirement.

Uncertainty Remains Among Immigrants
Although the U.S. government has effectively stepped back from the perception of a universal return-home requirement, some uncertainty remains among immigrants regarding how Green Card processing policies may evolve in the future. Applicants and immigration advocates continue to closely monitor developments as the administration refines its approach to legal immigration and residency approvals.
