A federal court in the United States has dealt a major setback to a decision taken by President Donald Trump. In January this year, the Trump administration had issued orders completely suspending immigrant visa processing for citizens of 75 countries worldwide, including Pakistan, Bangladesh, Nepal, and Russia. However, after hearing petitions challenging this decision, a US District Court has delivered a sweeping ruling, completely striking down the orders issued by the Trump administration.
During the hearing, US District Judge Jeannette made key observations, with the court clearly stating that the visa ban imposed on citizens of 75 countries was entirely inconsistent with federal immigration law. The ruling noted that neither the Secretary of State nor the government has the authority to override the independent discretion of consular officers in the granting and processing of immigrant visas. The court made clear that the government does not have the legal authority to blindly suspend visas on a country-by-country basis.
At the time these visa restrictions were imposed, the Trump administration and the US State Department had defended the decision, alleging that immigrants from the 75 banned countries were making unacceptable use of welfare programmes and funds meant for American citizens. The government had stated that the suspension of these visas would continue until it was fully established that new immigrants would not become a burden on the US economy and its people, describing the strict measures as part of its “America First” policy.
The federal court’s landmark ruling has brought relief to thousands of applicants and their families who have been waiting for visas for several months now. With the court making it clear that the government does not have the authority to alter immigration rules at will, the ruling has dealt a significant blow to the Trump administration.
